Each bidder must be properly registered and have buyer’s number to participate in the auction. By participating in the auction Buyer expressly agrees to adhere to these Auction Terms and Conditions and to the terms and conditions of the Livestock Forward Contract published in this catalog.

The Auctioneer reserves the right to reject any and all bids.

If a dispute arises between two or more bidders, the Auctioneer may immediately put the lot up for sale again and resell to the highest bidder. The decision of the Auctioneer shall be final and absolute.

The record of sale kept by the Auctioneer and Clerk will be taken as final in the event of any dispute.

All purchases require a $40.00 per head Part Payment which is due and payable at the conclusion of the auction. All Part Payments must be sent by ACH, Wire Transfer or overnight delivery of a check via FedEx or UPS on the first business day following the conclusion of the auction.

Final Payment is due and payable upon delivery of the cattle. In the event of multiple day deliveries, payment will be required on each day’s delivery. If buyer is present at delivery, payment is due at delivery. If Buyer is not present at delivery, payment must be sent to Superior Livestock the day after the cattle are received by Buyer. All payments must be sent by ACH, Wire Transfer or overnight delivery of a check via FedEx or UPS. Payment sent via the U.S. Postal Service (1st Class, Priority or Express) is not acceptable. Any fees incurred for sending payment will be at the Buyer’s expense.

Unless otherwise stated, all bred heifers and bred cows will be pregnancy checked, safe with calf, by a licensed veterinarian within 21 days prior to delivery. A veterinarian’s certificate with the latest pregnancy test results will be furnished to the buyer at delivery. Replacement heifers that are guaranteed open will be pregnancy checked by a licensed veterinarian and a veterinarian’s certificate will be furnished to the buyer at delivery.

All females will be sold on a sliding scale from the base weight, on the bottom side only. The slide will be 80 cents on heifers & 50 cents on cows. Example: Bred Heifers with a base weight of 1,000 pounds sell for $2,000.00 per head. If, at delivery, the heifers average 950 pounds, the price will be adjusted 50 pounds at 80 cents per pound, for a total of $40.00 per head, for an adjusted price of $1,960.00 per head.

Not all females in this offering are Bangs vaccinated and may not meet import requirements for some states. Bangs vaccination information is noted in each lot.

Health entry requirements for the state of entry are the responsibility of the Buyer. Seller will furnish any health certificates required for the state of origin and Federal law. If additional health certificates, tests or documentation are required for shipment, it shall be at the Buyer’s request and expense.
